Allan swapped Napoli for Everton in the summer of 2020 and has been a regular for the Merseyside club since then.
In his final season with the Italian club, the midfielder and his then teammates refused to go to the ritiro [retreat] ordered by president Aurelio De Laurentiis on November 5th, 2019.
The ‘mutiny’ left the Serie A side unhappy, who stated they would ‘proceed to protect its rights on economic, capital, image and disciplinary rights in every competent jurisdiction’.
When the saga took place, the Toffees midfielder was sidelined with an injury. Despite the injury, the Brazilian decided to stand with his former teammates.
According to Corriere del Mezzogiorno, the Everton player was not supposed to be there since he was ‘prescribed absolute rest’ by Napoli doctor, Raffaele Canonico.
The report says the South American was ‘among the promoters of the mutiny’. Therefore, Napoli ‘take Allan to court’.
For Elseid Hysaj and Nikola Maksimović, who have already left the club, the request is 25 percent of the monthly salary at the time. Since the figure is less than €50,000, the jurisdiction for legal process will be in Rome.
In Allan’s case, however, ‘story has a different weight’ since he had disagreement with the Serie A side’s vice-president, Edoardo De Laurentiis. Napoli are demanding 50 percent of his salary, considering the club’s image was damaged by the mutiny.
It’s not made clear whether the salary is for the month of November or for the entire 2019/20 season.
Corriere del Mezzogiorno say the 30-year-old will have to join the court hearing via video conference on October 14th. He will be defended by Gianandrea Pilla, appointed by lawyer Roberto Ninno, while Napoli will rely on lawyer Bruno Piacci.
The report further states: ‘An image damage on which Napoli absolutely does not intend to stop, the first hearing will not be definitive, another one should be scheduled in which Allan could decide to involve three former Azzurri men: Hysaj, Maksimovic and Carlo Ancelotti.’
